The Law Office of Gary E. Powell
I work extensively with individuals, businesses, developers and local government units in all matters related to land use and zoning, from applications for rezoning and variances to administrative zoning appeals. I also work proactively with governmental bodies to develop creative, comprehensive land use strategies in an effort to minimize the risks associated with litigation.
I have been an adjunct faculty member at the University of Cincinnati since 1986. I most recently taught Planning Law and Administration to graduate and undergraduate Planning students in the College of Design, Architecture, Art and Planning (DAAP). Along that same line, I frequently present seminars on proper zoning practices for planning and zoning commissions, as well as boards of zoning appeals.
My practice also includes work with individuals and municipalities to resolve disputes when governments exercise their powers of eminent domain to take private property for public purposes.

Corporate and Contract Law
My work with small businesses and corporations includes representation in complex litigation. I act as counsel to businesses and commercial enterprises involved in lawsuits involving construction disputes, breach of contract, and other business-related issues. I was recently counsel to a private construction firm that successfully challenged the City of Cincinnati's public bidding ordinances.
I also assist clients in negotiation, review and preparation of business contracts. I assist small businesses and corporations with a wide range of commercial agreements, including sales contracts, vendor agreements, employment contracts and non-disclosure and non-compete agreements. If you have company secrets that need to be protected or if you want to prevent employees from using the training and experience you provided them to compete against you, I can help you prepare and execute effective agreements that prevent disclosure and unfair competition.
Fraternity Law and Hazing
I have extensive experience handling a wide range of legal issues faced by fraternities and sororities across Ohio and the United States. I have worked with educational institutions as well as represented national fraternities in cases involving allegations of fraternity hazing. I have considerable experience dealing with liability issues that arise from hazing and was referred to as a "hazing expert" by the New York Times in 2000, and again in 2008 by such national media outlets as MSNBC and USA Today.
